Terms And Conditions

DM4PM.com is owned and operated by Mad Capper Studios, Inc. (“Mad Capper”, “we”, “us”, “our”).

These Terms of Service (“Terms”, “Agreement”) govern your use of DM4PM.com, the ScoreBig CRM, our marketing programs, automation tools, video services, coaching, consulting, and all subscription and add-on services provided by Mad Capper Studios, Inc.

By purchasing, subscribing, accessing, or using any DM4PM service, you agree to these Terms.

1. Overview of Services

DM4PM provides digital marketing, automation, CRM tools, video content, templates, advertising services, consulting, training, and related business growth services for property management companies and related industries.

These Terms apply to all current and future DM4PM products, services, subscription plans, add-ons, one-time projects, custom work, consulting, and related offerings provided by Mad Capper Studios, Inc., whether purchased through DM4PM.com, ScoreBig CRM, a proposal, invoice, checkout page, order form, or other written agreement.

Specific pricing, deliverables, included features, and service scope may be described separately on our website, pricing pages, proposals, invoices, order forms, or checkout pages, which are incorporated into your service relationship as applicable.

2. Payments, Billing, and Auto-Renewal

All DM4PM subscriptions automatically renew every month unless canceled with at least 30 days’ written notice.

  • All payments are non-refundable.
  • Setup fees are non-refundable, except under the limited guarantee listed in Section 8.
  • Your card or banking information on file will be billed automatically through Stripe or QuickBooks.
  • Charges for third-party services such as SMS, phone, and email usage (Twilio, Mailgun, SmartLead, etc.) occur separately.
  • Non-payment for 30 days may result in suspension of your account and services.
  • Communication usage charges are billed through your CRM wallet as described in Section 8.

Sleep Mode (Paused Account)

You may pause your account instead of fully canceling it.

Cost: $47 per month

Sleep Mode is intended for clients who may want to return later without rebuilding their ScoreBig system from scratch.

Sleep Mode preserves:

  • your CRM setup
  • historical data
  • workflows
  • pipelines
  • tags
  • customizations
  • templates assigned to your account

Sleep Mode may disable or pause:

  • active campaign sending
  • automations running
  • SMS sending
  • email sending
  • phone call features
  • add-on service fulfillment

If you do not choose Sleep Mode, your account and data may be deleted upon cancellation and may not be recoverable.

3. Term, Cancellation & Termination

A. Customer Cancellation

You may cancel your subscription or add-on services by providing at least 30 days’ written notice through an approved DM4PM cancellation channel.

Approved cancellation channels include:

  • email to support@dm4pm.com
  • your DM4PM customer support page 
  • Self-cancellation inside of ScoreBig CRM > Settings > Billing > Cancel

Verbal, text, and Slack cancellations are not accepted.

Unless you request earlier shutdown in writing, your access and active services remain available until the later of:

  • 30 days after your written cancellation request is received, or
  • the end of your current paid billing cycle

If you request earlier shutdown, DM4PM may disable automations, outbound activity, CRM access, communication features, and related services before the end of the notice period or billing cycle. You understand that requesting early shutdown may prevent completion of data exports, phone-number transfers, or other offboarding tasks.

If you request offboarding assistance and required offboarding items remain unresolved as your next billing cycle approaches, additional charges may apply until the requested offboarding work is completed or the services are fully shut down.

After termination:

  • your access is removed
  • you are responsible for exporting your data before your final access date
  • DM4PM is not responsible for data loss after account closure
  • you may request Sleep Mode instead of full cancellation

Offboarding Responsibilities

Before your final access date, you are responsible for exporting any data you wish to keep, including available contacts, conversations, opportunities, reports, form submissions, appointments, tags, and other accessible records.

If your account includes DM4PM-provisioned phone numbers, you must provide written instructions for whether those numbers should be ported, moved, or released. Phone-number transfer requests cannot be completed until all required information, supporting documentation, and destination details have been submitted.

You are also responsible for updating all third-party lead sources, forwarding rules, forms, and integrations connected to your account, including replacing any DM4PM-managed receiving addresses or routing destinations that should no longer remain active after termination.

This includes updating any lead-source routing that may still point to addresses such as leadsync@scorebig.online in platforms or vendors such as APM, Geek Leads, or any other lead source you use.

DM4PM is not responsible for lost data, missed leads, failed routing, or failed transfers resulting from incomplete offboarding instructions or the client’s failure to complete required offboarding steps before shutdown.

B. Company Cancellation

DM4PM may terminate immediately if:

  • You violate these Terms
  • You fail to pay within the 30-day grace period
  • You abuse the system
  • You conduct illegal, spam, or high-risk SMS/email activity
  • You engage in account sharing, copying, distribution, or theft of IP
  • You violate A2P/TCPA or email compliance rules

4. No Refund Policy

Except for the Limited Performance Guarantee in Section 8:

  • There are no refunds for monthly subscriptions
  • There are no refunds for setup fees
  • There are no refunds for add-on services
  • There are no refunds for usage credits, gift card reimbursements, ad spend, or third-party expenses
  • Wallet deposits and usage charges are non-refundable once processed.

     

5. Use of Third-Party Platforms (Important)

DM4PM relies on multiple third-party systems, including but not limited to:

  • Twilio (SMS + Phone)
  • Mailgun (Email)
  • SmartLead (Outbound Email Platform)
  • ScoreBig CRM (HighLevel Infrastructure)
  • Google Ads, Facebook, Instagram, LinkedIn, Yelp
  • Yext
  • YouTube, Vimeo, Loom
  • Zapier
  • Make.com
  • N8N

Because these platforms are outside our control, you agree that DM4PM is not responsible for:

  • Account suspensions
  • API changes
  • Outages or downtime
  • Delivery failures
  • Email spam filtering
  • SMS filtering or carrier shutdowns
  • A2P registration delays
  • Ad disapprovals
  • Policy changes from tech platforms
  • Platform bans due to user behavior

DM4PM cannot guarantee:

  • email inbox placement
  • SMS delivery
  • phone call quality
  • ad performance
  • platform uptime

6. Customer Responsibilities

To use DM4PM services you agree to:

  • Provide required access, logins, credentials, domain records, DNS access, and business info
  • Attend onboarding calls, training, and strategy sessions
  • Complete required form submissions
  • Maintain compliance with A2P, TCPA, CAN-SPAM, and all local laws
  • Use calling and recording tools in accordance with state and federal laws
  • Not engage in spam or prohibited SMS/email activity
  • Not duplicate, screenshot, or redistribute DM4PM intellectual property
  • Not change passwords on connected accounts without notifying us (this breaks automations)

Failure to cooperate, communicate, or provide deliverables voids any guarantees.

7. SMS, Email, and Compliance Rules

DM4PM provides communication functionality through the ScoreBig CRM, including SMS, phone calling, voicemail, and email services. These features rely on third-party providers, including but not limited to Twilio (SMS/Voice) and Mailgun (Email).

You acknowledge and agree that:

  • Message delivery and call quality are dependent on carrier networks and third-party providers and are not guaranteed.

  • You are solely responsible for compliance with all applicable laws and regulations, including but not limited to TCPA, CAN-SPAM, and A2P 10DLC requirements.

  • Messaging that violates carrier policies or applicable laws may result in carrier restrictions, number suspension, or account limitations.

  • All communications sent through your account are the responsibility of the account holder.

8. Communication Wallet, Usage Rates & Auto-Recharge

A. Usage-Based Communication Charges

SMS, calling, and email usage within the CRM are billed on a usage basis. Charges are deducted only when messages are sent, calls are placed or received, or emails are delivered.

Current estimated usage rates:

  • SMS: $0.0249 per segment (approximately 400 segments per $10)

  • Outbound Calls: $0.042 per minute

  • Inbound Calls: $0.0255 per minute

  • Email: $0.00675 per email (approximately 1,480 emails per $10)

Message segments are determined by carrier standards and message length. Rates may be updated periodically to reflect carrier fees, regulatory surcharges, provider pricing changes, or platform cost adjustments. Updated rates become effective immediately upon posting within the CRM platform or upon updating this Agreement. Continued use of communication services constitutes acceptance of updated rates.

Certain carriers may impose additional regulatory, compliance, or network surcharges (including A2P 10DLC fees or campaign fees). These charges are outside of DM4PM’s control and will be passed through to the account holder where applicable.

 

 


B. Communication Wallet

All usage charges are deducted from your CRM wallet balance within the ScoreBig platform.


C. Auto-Recharge

To help prevent interruption of messaging and calling services, accounts are configured with automatic recharge settings unless otherwise modified by the account holder. The default configuration is:

  • Recharge amount: $50

  • Trigger threshold: $10

If the wallet balance reaches $0 or a recharge attempt fails, communication services (SMS, calls, email) may pause until sufficient funds are available.

You are responsible for maintaining a valid payment method on file to support automatic recharge functionality.


D. Viewing and Adjusting Wallet Settings

Wallet balance, recharge settings, and detailed transaction history can be viewed or adjusted at any time within the CRM by navigating to:

Settings → Billing → Wallet & Transactions

This section provides full transparency into wallet activity and usage charges.


E. Authorization

By enabling or using communication features within the CRM, you authorize Mad Capper Studios, Inc. to automatically charge your payment method on file for wallet recharges based on your selected recharge settings. You acknowledge that automatic recharges are required to maintain uninterrupted communication services.

 

9. Limited Performance Guarantee (Setup Fee Refund Eligibility)

This guarantee applies only to the initial setup fee, not monthly subscriptions.

You may request a refund of the setup fee between:

Day 90 through Day 120

(or before billing month 4 begins)

IF AND ONLY IF all of the following conditions are met:

Eligibility Requirements

You must have:

  1. Provided all required information, access, logins, and business assets
  2. Completed the recommended training videos
  3. Attended at least 8 of 12 weekly onboarding/strategy Zoom calls
  4. Actively cooperated and communicated with DM4PM
  5. Allowed a reasonable time for DM4PM to complete setup
  6. Not violated any Terms in this document
  7. Not delayed progress by withholding needed materials
  8. Replied to necessary communications via platforms like email, Slack, phone, and SMS

What the Guarantee Covers

You may request a refund only if DM4PM fails to deliver the core setup:

  • CRM setup
  • Campaign installation
  • Required onboarding integrations
  • Marketing assets promised
  • Video integrations (where applicable)

DM4PM is not responsible for delays caused by the client.

10. Intellectual Property (Very Important)

All DM4PM products, materials, and assets are owned by Mad Capper Studios, Inc.

This includes:

  • CRM automations and workflows
  • Pipeline structures
  • Email/SMS templates
  • Scripts and voice workflows
  • Video library content
  • Social media library content
  • Onboarding systems
  • AI automations
  • Outbound email systems
  • Custom funnel and form templates
  • Training materials
  • Processes and frameworks
  • Custom code, setups, and system configurations

Client-Owned Assets

The client owns:

  • Final custom-branded videos created specifically for the client
  • Final custom-branded social media content created specifically for the client
  • Any custom branding or custom content you provide to us

DM4PM-Owned Assets

Clients do not own:

  • non-branded video library content
  • templates
  • automations
  • workflows
  • scripts
  • systems used to create custom videos
  • standard system videos or assets
  • any content included “as part of a subscription”

These remain the sole property of Mad Capper Studios, Inc.

License to Use

Clients may use DM4PM materials only while on an active paid subscription.

Upon cancellation:

  • All licenses terminate
  • All DM4PM assets must cease being used
  • Videos may not be duplicated
  • Workflows may not be exported
  • Templates may not be reused
  • Video library content may not be downloaded or redistributed (without written approval)

Purchasing Permanent Rights

Clients may request to purchase a perpetual license to any individual non-branded or branded video asset for a fee (typically $250–$500 per video).

11. Data Ownership & After Termination

Your customer data, including contacts, conversations, and leads, remains yours.

Upon cancellation:

  • you may export available data before your final access date
  • if you choose Sleep Mode, your core account data remains intact
  • if you choose full cancellation, data may be deleted and recovery may not be possible

Additional offboarding requirements, including phone-number instructions, lead-source updates, and export responsibilities, are governed by Section 3 and the Termination of Services Policy.

12. No Guarantees of Performance

DM4PM does not guarantee:

  • Leads
  • Referrals
  • Sales
  • Revenue
  • Property doors acquired
  • Appointment volume
  • Google rankings
  • Ad conversion rates
  • ROI
  • Email or SMS deliverability
  • Accuracy of AI-generated content

Marketing results vary based on client effort, market conditions, competition, pricing, response time, and other external factors.

13. Non-Disparagement & Confidentiality

You agree not to:

  • Publicly defame, disparage, or harm the reputation of DM4PM or Mad Capper Studios, Inc.
  • Publish private communications or internal processes
  • Share login credentials
  • Reverse-engineer or copy DM4PM systems
  • Distribute or resell our workflows, videos, or materials

You must attempt private resolution with DM4PM before posting public criticism.

Violation may result in immediate termination and legal action.

14. Limitation of Liability

To the fullest extent permitted by law:

  • DM4PM’s maximum liability is limited to the total of your setup fee
  • DM4PM is not responsible for:
    • lost revenue or profits
    • lost opportunities
    • data loss
    • downtime
    • third-party failures
    • SMS/email spam filtering
    • account suspensions by platforms
    • carrier penalties
    • advertising performance
    • content inaccuracies (including AI output)
    • communication wallet recharge disputes, carrier fee changes, or usage-based billing fluctuations

This remains true even if the possibility of damage was known.

15. Governing Law, Arbitration & Disputes

This Agreement is governed by the laws of the State of California.

Any dispute must:

  1. First be handled via good-faith mediation
  2. Then, if unresolved, proceed to binding arbitration
    • Location: Los Angeles County, CA
    • Disputes shall be resolved by binding arbitration administered by JAMS or the American Arbitration Association (AAA), at DM4PM’s election.
  3. The prevailing party is entitled to reasonable attorney’s fees and arbitration costs

You waive all rights to participate in class actions or jury trials.

16. Changes to Terms

DM4PM may update these Terms at any time. Updates take effect once posted on DM4PM.com. Continued use indicates acceptance.
